The Edmonton Zoning Bylaw defines a garden suite as: An accessory building containing a dwelling, which is located separately from a principal dwelling that is single detached housing, and which may contain a parking area. A garden suite has cooking, sleeping and sanitary facilities which are separate from those of the principal dwelling.

In the past, garden suites were only eligible in certain locations, like corner lots or next to commercial zones, and lots over a certain size. Today, because of updates to the Zoning Bylaw, a garden suite can be built on most low density residential lots.
